Terms of Use
These terms govern your use of thethreshold.report, the newsletter, the archives and related tools (together, the "Service"), operated by Evoke Digital Media and Publishing, LLC ("we", "us"). By using the Service, you agree to these terms. If you do not agree, do not use it.
1. Information only, not advice
Everything in the Service is general information and editorial commentary. It is not investment, financial, legal, security or other professional advice, it does not consider your circumstances, and it creates no advisory, fiduciary or professional relationship. Nothing in it is an offer or recommendation to buy, sell or hold any security. Do your own research and consult a qualified professional before acting. See our Disclosures.
2. Editorial judgments and accuracy
Board answers, the security dial, lane scores, labels such as "Real" or "Not yet", and our selections are editorial opinions about the evidence available at the time. They are not guarantees about any product, company, technology or outcome. We work to be accurate and correct errors, but content can contain mistakes, rely on sources that change, or become outdated. Archived reports describe things as they stood on their date.
3. Our content and how you may use it
The Service and its original content (text, scores, charts, compilations, design and illustrations) are owned by us or our licensors and protected by copyright and other laws. You may read it, share links to it, quote brief excerpts with attribution and a link, and keep personal copies. Anything else requires our written permission, including:
- republishing, redistributing or selling our content, or substantial parts of it;
- scraping, crawling or bulk downloading the Service, or extracting its data, by any automated means (ordinary search-engine indexing excepted);
- using any part of the Service to train, fine-tune, ground or evaluate an artificial-intelligence model, or to build a competing product or dataset;
- removing attribution or copyright notices, or presenting our content in a way that suggests we endorse you.
"The Threshold Report" and our logo are our trademarks. These terms do not limit fair use or any other right the law gives you.
4. Third-party material
We link to, quote and summarize outside sources, and Market Watch is based on holdings files published by fund issuers. Third-party content, trademarks and services belong to their owners, who are responsible for them. A link, mention, listing or advertisement is not an endorsement, partnership or affiliation.
5. Questions and other material you send us
Questions you submit for the Board, and any feedback or other material you send us ("Submissions"), are not confidential. Once approved, a question is published and public. By sending a Submission you confirm that you have the right to share it and that it is lawful, and you grant us a free, perpetual, irrevocable, worldwide, transferable and sublicensable license to use, copy, edit, adapt, publish, distribute, track, answer and build on it in any form and for any purpose connected with the Service, with or without the name and location you supplied, and to decline, change, remove or delete it at any time. You waive any moral rights or rights of attribution in it, and you are owed no payment or credit for it.
Questions about what AI can do are ideas that many people share. Other readers may submit, and we may publish, questions that are the same as or similar to yours. You agree that you will not bring any claim against us, or against any other reader, based on the similarity of a question to one you submitted. Your personal information is handled under our Privacy Policy.
6. Acceptable use
Do not break the law through the Service, interfere with or overload it, probe or bypass its security, introduce malicious code, misrepresent who you are, or submit unlawful, infringing or abusive material. We may suspend or block access, or remove material, to protect the Service, its readers or our rights.
7. Newsletter and alerts
Subscribe only with an email address you control. You can unsubscribe at any time. We may change, pause or stop any part of the Service, including publishing schedules, without notice.
8. Advertising and sponsorship
Paid placements are labeled as such. Advertisers are responsible for their own claims, products and services. Separate written agreements govern advertising and sponsorship and prevail over these terms for those arrangements.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, and we do not warrant that the Service will be uninterrupted, timely, secure or error-free.
10. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, trading or investment losses, lost data or business interruption, arising from or related to the Service, even if advised of their possibility. Our total liability to you for all claims relating to the Service is limited to US $100.
Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
11. Indemnity
You will defend, indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your violation of these terms, your misuse of the Service, or material you submit.
12. Governing law and disputes
These terms are governed by the laws of the State of Illinois and applicable US federal law, without regard to conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Illinois, and you consent to their jurisdiction, except that either side may bring an individual claim in small-claims court. Any claim must be brought within one year after it arises, or it is permanently barred, unless the law requires a longer period. Please email us first; most concerns can be resolved informally.
13. Copyright complaints
If you believe material on the Service infringes your copyright, email legal@thethreshold.report with: the work you claim is infringed, the material and where it appears, your contact details, a statement that you believe in good faith the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your physical or electronic signature. We respond to valid notices and may remove material.
14. General
We may update these terms by posting a new version here and updating the date at the top; continuing to use the Service after that means you accept the update. If any provision is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these terms; we may transfer ours. These terms, with our Privacy Policy and Disclosures, are the entire agreement between you and us about the Service.
